These Terms of Service ("Terms") govern your use of PokeCampus (the "Service"), provided by Imaginix Inc. ("we", "us", or "the Company"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 16 years old to use the Service. By using it you represent that you meet this requirement and that the information you provide is accurate.

Your Account

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not misuse the Service, interfere with its operation, attempt to access it through unauthorized means, or use it to access content you are not authorized to access.

The Service and its original content, features, and functionality are and will remain the exclusive property of the Company and its licensors. Content you process through the Service remains yours; you grant us only the limited rights needed to provide the Service to you.

The Service may link to or integrate third-party websites and services, including Canvas LMS and authentication providers. We do not control and assume no responsibility for the content, privacy policies, or practices of any third party.

Termination

We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, the Company's total liability for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service, or USD $100 if you have not made any payments.

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

If you have any concern or dispute about the Service, you agree to first try to resolve it informally by contacting us.

Changes to These Terms

We may modify these Terms from time to time. For material changes we will provide at least 30 days' notice before they take effect. Continued use of the Service after changes become effective constitutes acceptance.
